Significant Support To The Decision Made By The Zambian President.

Dr. Rajan Lekhraj Mahtani, a noted businessman and philanthropist from Zambia, recently extended his support to the Zambian President’s decision. President Hakainde Hichilema, on Africa Day, announced his quest towards completely abolishing the death penalty row. Dr. Rajan Lekhraj Mahtani is one of the top businessmen, philanthropists, and charity workers from Zambia. He is known for several successful ventures such as Mahtani Group of Companies and Finsbury Investments. Apart from these business ventures spanning over four decades, Dr. Mahtani is also known for his philanthropic and charitable contributions. One of his notable philanthropic contributions has been Prison Fellowship Zambia, established around three decades ago. Prison Fellowship was founded by Dr. Rajan Lekhraj Mahtani himself, and he is currently acting as Group Chairman of this philanthropic organization. Prison Fellowship Zambia (PFZ) has established itself as a noted Christian Outreach Program (COP) focusing on providing transparent criminal justice to prisoners, ex-prisoners as well as their families in Zambia. The program also works by providing fundamental human rights and basic human dignity to the prisoners in Zambia. At the same time, the primary objective of the institution is to bring the teachings and learnings of Jesus Christ to the prisoners in Zambia.

Dr. Rajan Mahtani praised the decision made by the Zambian President, stating that he made a bold yet much-needed announcement that was expected from the past President but could not be delivered by them. There is a growing awareness regarding abolishing the death penalty across the globe and this can be seen in Zambia too. The last time a capital execution was given by a President was in the year 1997. Since then, Presidents have been tactically avoiding the capital punishment process and giving mercies to the prisoners. At the same time, the present condition of several prisons is extremely degrading with many prisoners living a life of ‘hell on earth as such, it can be said that giving the death penalty to these prisoners does not make any sense and Dr. Rajan Mahtani did the right decision by planning to abolish the death penalty.

Dr. Rajan Lekhraj Mahtani, in a recent interview with ‘Mast Newspaper’ extended his full support towards the recent decision made by the Zambian President. On the occasion of Africa Day, President Hakainde Hichilema announced that he is planning to abolish the death penalty row. As per Dr. Rajan Mahtani, it was a welcome move considering the law of death penalty is inhumane, cruel and degrading. As such, Dr. Rajan Mahtani praised the announcement made by the Zambian President and said that only a noble person will have the courage to make such decisions. Dr. Rajan Mahtani, while adding his voice to this announcement, stated that there is a significant difference between making the such a bold announcement and making it a reality. This is due to the significant bureaucracy, corruption and long processes within the government to change an archaic yet old and established law. As such, Prison Fellowship will provide legal and regulatory support to ensure that the announcement sees the light of day.

Challenge By Ventriglias Regarding Portland Cement Fails, Supreme Court Rejects Plea

Zambezi Portland Cement is a factory in Zambia which has been contested for many decades now. According to the latest decision from the Higher Court of Appeal judge, the factory legally belongs to Dr. Rajan Lekhraj Mahtani.

Few months after this decision from the higher Court of Appeal, the Ventriglias family decided to challenge this decision by taking the case to the Supreme Court of Zambia. In their appeal, Antonio and Manuela Ventriglia cited that the judgement by justice Siavwapa from the higher Court of Appeal was incorrect. In the previous decision from the higher Court of Appeal, it was announced that the Finsbury Investments owned by Dr. Rajan Mahtani holds 58 percent shares of the Zambezi Portland Cement and the Ventriglias’ owned Ital Terrazzo Limited holds 42 percent shares at the factory. Based on this shareholding pattern, it is established that Dr. Rajan Lekhraj Mahtani is the actual owner of the factory. At the same time, the final amount payable to the Ventriglias for the majority shares owned by Finsbury Investments was K580,000. The Ventriglias, in their challenge at the Supreme Court, said that correct payable amount was K580 million.

As of now, a bench comprising of three Supreme Court judges have rejected the appeal from Ventriglias for challenging the decision from the higher Court of Appeal. The bench of judges said that they did not have any jurisdiction on this case and the circumstances associated with the appeal from the Ventriglias were flawed. Furthermore, it was also found that the Ventriglias did not comply with legal regulations when making the appeal. According to law, one has to launch their appeal against any court decision within 14 days of the judgement itself. The final decision from the higher Court of Appeal came on 31st January 2019 and the Ventriglias made this appeal more than a year later. As such, their appeal is legally not valid and the judgement from the higher Court of Appeal is binding for the case.

The Portland Cement Zambia is a noted factory in Zambia with many accomplishments under its belt. Since its establishment by Dr. Rajan Mahtani, the factory has achieved numerous feats. For instance, the factory quickly became one of the biggest producers of cement in Zambia attracting numerous accolades and compliments. The factory also provided wages and salaries higher than industry standards, improving the employment standards across the nation and showing signs of progress. Dr. Rajan Mahtani is the real owner of the factory and these achievements were made under his name. However, the present condition of the factory is unbearable as a result of the case going for its legal takeover.

Some of the top evidences submitted by Dr. Rajan Mahtani included signed shareholder’s agreement, financial exhibits which clearly indicated his investments more than USD 12 million in the factory’s development and growth as well as audit report conducted by an independent auditor which clarifies the fact that the Portland Cement Zambia factory was established as a joint venture and Dr. Rajan Mahtani was the sole joint venture partner of the factory with rest of the members being shareholders. The judge who gave the final judgment also announced sometime back that the case hearing is closed. Both sides were asked to submit their evidence and testimonials in written and oral format, based on which the final announcement was to be made.

However, the final verdict made by the judge was unexpected. In his final statement, the Lusaka High Court judge rejected the claims made by Dr. Rajan Mahtani. It was a clear case of misdirected and skewed judgment from the Lusaka High Court judge. It was a shocking verdict for Dr. Mahtani too who was expecting a clear win. However, Dr. Rajan Mahtani is not dejected now and has made an appeal to the higher court of Zambia against this judgment made by the Lusaka High Court justice.
