Significant Support To The Decision Made By The Zambian President.

Dr. Rajan Lekhraj Mahtani, a noted businessman and philanthropist from Zambia, recently extended his support to the Zambian President’s decision. President Hakainde Hichilema, on Africa Day, announced his quest towards completely abolishing the death penalty row. Dr. Rajan Lekhraj Mahtani is one of the top businessmen, philanthropists, and charity workers from Zambia. He is known for several successful ventures such as Mahtani Group of Companies and Finsbury Investments. The last time a capital execution was given by a President was in the year 1997. Since then, Presidents have been tactically avoiding the capital punishment process and giving mercies to the prisoners. At the same time, the present condition of several prisons is extremely degrading with many prisoners living a life of ‘hell on earth as such, it can be said that giving the death penalty to these prisoners does not make any sense and Dr. Rajan Mahtani did the right decision by planning to abolish the death penalty.

Dr. Rajan Mahtani, despite remaining honest, ethical and transparent, achieved significant business success. This is the same philosophy of Dr. Kenneth Kaunda which Dr. Rajan Mahtani promotes and urges all Zambians to follow in their lives. Despite sharing evidences, the Lusaka High Court judge gave a decision which came to be extremely controversial. The Ventriglias, and not Dr. Rajan Mahtani was announced as owner of the factory. After this judgement which was extremely misdirected, Dr. Rajan Mahtani rightly re-registered the case at the higher Court of Appeal. The judge at the higher Court of Appeal was justice Mwinde and after looking into all evidences and testimonials submitted, final decision was given. Justice Mwinde announced Dr. Rajan Mahtani as actual owner of the Portland Cement Zambia factory. This announcement was made on 31st January 2019 after sharing all details associated with the case.

Furthermore, this amount equalled 1 billion kwacha and this share transfer was clearly established in the original Shareholders Agreement established on 26th February 2007 and was found in the page number 662 of the volume-Record of Appeal in the agreement. This evidence further solidified Dr. Mahtani legal ownership over the factory. Furthermore, justice Mwinde also declared that it was the responsibility of the transferor to pay the PTT (Property Transfer Tax) and thus, Dr. Rajan Mahtani was acquitted from any type of tax payment as he has already completed his responsibilities in terms of payments for the factory. Dr. Rajan Mahtani is innocent in the 2012 case as per Hon. Justice Mumba Malila

Hon. Mr. Justice Mumba Malila

Hon. Mr. Justice Mumba Malila

Hon. Justice Mumba Malila recently provided a testimony before the Supreme Court of Zambia. Justice Mumba Malila is an honourable judge from the Supreme Court Zambia and his testimony revealed widespread corruption and wrongdoings within the Zambian nation. While he provided several testimonies; the one which was most talked about was related to Dr. Rajan Mahtani and the case of 2012. Dr. Rajan Mahtani is a businessman and noted industrialist in Zambia. He has been working in Zambia for the past thirty years during which he built several successful companies such as Mahtani Group of Companies and Finsbury Investments. Dr. Rajan Mahtani is also known for his charitable and philanthropic activities as well as working for the welfare and economic development of the nation. He is also among the few businessmen in Zambia who has been able to bring foreign investments from developed nations such as United Kingdom and improve the economic conditions of Zambia. Despite these significant contributions, Dr. Rajan Mahtani is often targeted by conspirators for personal gains.

The testimony from the Supreme Court Zambia Justice exposes a similar level of corruption wherein innocent and ethical businessmen like Dr. Rajan Mahtani suffer due to the unethical practices and power of corrupt people. In his testimony, Justice Mumba Malila revealed that the case of 2012 which went against Dr. Rajan Mahtani was unethical and was against the interests of the public policies. The case was motivated by several political undertones. Justice Mumba Malila was the attorney general during that time and he made several attempts to make the case null and void. However, no such actions were taken by the Tribunal and it was clear that the decision making was influenced by external factors, corrupt but having significant political power.

This testimony has certainly exposed this large-scale corruption across the Zambian government. However, the government itself needs to take immediate correctional measures for minimising such corrupt court practices.

Dr. Rajan Mahtani Not Satisfied With The Lusaka HC judgement, Claims It To Be Misdirected

Zambia is a comparatively small nation with limited number of industries and businesses. Among then, Dr. Rajan Mahtani has successfully carved out a name for himself with his three decades of business ventures as well as transparent business practices. He is in-charge of the some big organizations in Zambia, including Mahtani Group of Companies and Finsbury Investments. Indeed, even with these fruitful businesses, Dr. Mahtani is attempting to get equity because of the Zambian government. For as far back as ten years, Dr. Rajan Mahtani has been battling a case at the Lusaka High Court. This fight in court is for the responsibility for Cement Zambia, a cement producing organization. Amid this controversy, Dr. Rajan Mahtani and his group of legal counsellors have presented various confirmations and evidences. These confirmations have emphatically settled Dr. Rajan Mahtani’s case. A portion of these archives included consented to investor’s arrangement, money related records and a review report directed on the Portland Cement Zambia by a independent auditor which plainly settled the way that Dr. Mahtani was the sole joint endeavour of the manufacturing plant. Indeed, even with these sensible and solid confirmations, fair justice was never given by the court.

Dr Rajan Mahtani

In any case, the last decision made by the judge was a to a great degree horrifying occasion as the decision was given against Dr. Mahtani’s cases. This is unmistakably an instance of misled judgment from the high court. While this decision is surely a major blow for Dr. Mahtani’s understanding, the case isn’t finished yet. Dr. Rajan Mahtani has now documented a case at the higher court of appeal, requesting that the decision made at the Lusaka High Court was unjustified and ought to at any rate be re-examined by the higher court of advance. Answer is anticipated starting at now. The case at the Lusaka High Court is nowhere near end and Dr. Rajan Mahtani is ready to take the case to higher level of government if needed.

After The Judgment At The Lusaka High Court On Portland Cement, Dr. Mahtani Takes Another Step

The case of Portland Cement Zambia has made a mockery out of the Zambian law and government. During the trial of the case spanning for almost a decade, Dr. Mahtani and his team of lawyers have submitted numerous documents and evidences to prove his claim and legal ownership over the factory. Almost all these evidences were sufficient enough to establish the claims by Dr. Mahtani. The judge overseeing the case at the Lusaka High Court also seems to be going in the right direction when it was announced a few months back that the case hearing is closed. This meant that the judge will not be hearing any more arguments and taking any more trial sessions. Both parties were asked to submit their evidences in written and oral formats and based on these evidences only, the final verdict was to be announced. Expert opinion was clear on this; Dr. Rajan Mahtani is going to win the case as his evidences and testimonials are based on facts and truth.

Dr. Rajan Mahtani

However, it seems that the tables have turned and now the judge has acted in an unprecedented manner. Even after all the evidences and documents proved Dr. Mahtani to be the legal owner of the factory, the final verdict was announced against his claims. This was a shocking event even for Dr. Mahtani who was expecting a clear win. Dr. Mahtani is among the most transparent and ethical businessmen in Zambia. While he conducts his business with ethics and professional stance, he is also always speaking up against any corrupt event or malpractice. This was sure one of the most unfortunate events for the Zambian law and order and Dr. Mahtani is not going to sit down and accept this judgment as his fate. Instead, Dr. Rajan Mahtani has now approached the higher court of appeal to make a case against the judgment made at the Lusaka High Court.
