On the occasion of the Africa Day, President Hakainde Hichilema announced that he is planning to completely abolish the practice of death penalty as it is a cruel inhumane and degrading practice. Dr. Rajan Lekhraj Mahtani completely supported this decision by stating that he is proud of the decision made by the Zambian President and fully supports him in this endeavour. Dr. Rajan Mahtani also said that only an individual who is compassionate, respects ‘rule of law’ as well as fundamental human rights along with basic human dignity, will understand the need towards abolishing a degrading and inhumane punishment such as this. Dr. Rajan Mahtani further stated that the consensus towards abolishing death penalty has grown considerably across the globe and this trend can be seen across Zambia too. More than 380 prisoners including around 30 women are awaiting capital punishment across various Zambian prisons. Considering the fact that they are not aware of their execution date, every day is a dreadful event for them. Another fact is that the condition of Zambian prisons is extremely degrading and questionable. Dr. Guy Scott visited the Mukobeko Maximum prison when he was the acting President. He considered the condition of these prisons as hell.
In fact, the government of Zambia has already started taking action on this issue by collaborating with institutions such as Parole Board of Zambia and Correctional Facility for systematic decongestion of the prisons. Dr. Rajan Mahtani also said that he will provide legal and regulatory support to ensure the announcement becomes a reality soon.

Zambian President Decides To Work On Death Penalty Abolishment

Dr. Rajan Lekhraj Mahtani, noted businessman and philanthropist in Zambia, has extended his full support towards Zambian President’s decision. Recently, President of Zambia Hakainde Hichilema made a bold announcement that he is planning to abolish the death penalty row. According to Dr. Rajan Mahtani, more than 350 prisoners, including both men and women, are currently under the death penalty row. Being on this death penalty row is a significant punishment for the convicts as they expect execution at any day. While working with Prison Fellowship Zambia, Dr. Rajan Mahtani has observed that several inmates transformed themselves by dedicating entirely to the services of god and becoming law abiding citizens. Dr. Rajan Lekhraj Mahtani further stated that majority of the past Presidents have avoided death penalty row by using certain mercy perogatives. The last time death penalty was ordered was in the year 1997. Also, several organizations such as Correctional services and Parole Board have started to work with the Zambian Government towards planned release of the Zambian Prisoners after transforming this. This comes after several reports of inhumane and degrading living conditions across Zambian Prisons. Even former vice-presidents have considered the condition across Zambian prisons as hell and impossible to survive.
The consensus towards abolishing death penalty has grown significantly across the globe and across Africa. Even in Zambia, the voice is not new as many institutions and organizations have been working towards abolishing this cruel and inhumane practice. Even then, there was a need for involvement from the top government and this has now become a reality with the latest announcement made by the Zambian President. Dr. Rajan Mahtani also stated that there is a long road from announcing the intent to making it happen in a legal manner, which will require significant legal reforms. Expert Opinions And Evidences Does Not Support The Latest Judgment By Lusaka High Court

Dr. Rajan Mahtani has gained a positive reputation and popularity among local citizens with his sustainable business practices and with his focus towards the development of the society. Among the major challenges which Dr. Mahtani has faced over the years, the case of Portland Cement Zambia has been the most difficult. It is one of the longest pending corporate cases across any Zambian court, taking over a decade of the fight for the ownership of a large manufacturing factory.

The results of the case, however, took a lot of time due to several limitations from the court itself as well as issues associated with the parties fighting for the ownership over the factory. Sometimes the case trials got delayed due to the unavailability of the parties or lack of evidence. Other times the judges were not available or got transferred and the new judge took over starting the case all over again. However, a positive announcement was made a few months back when the current justice overseeing the case announced that the case hearing is closed. This meant that the judge will not be taking further trials and both parties were asked to submit their evidence in written and oral formats for analysis. The judge announced the final verdict against Dr. Mahtani. However, Dr. Mahtani is not the one to lose hope and has now filed an appeal to the higher court of Zambia.
